Introduction

This Service Agreement (“Agreement”) governs the relationship between ATOZRDP (“Service Provider,” “we,” “us,” or “our”) and any individual or entity (“Subscriber,” “you,” or “your”) that accesses or uses our Windows RDP and VPS hosting services (the “Service”).

By accessing or using our services, you agree to be bound by the terms and conditions set forth in this Agreement.

Acceptance and Assignment

Acceptance of this Agreement occurs when you submit an order through the ATOZRDP website or access the Service. Confirmation of acceptance is provided via electronic mail.

The Subscriber may not assign, transfer, or delegate any rights or obligations under this Agreement without prior written consent from ATOZRDP. Any unauthorized assignment shall be considered void.

Services

ATOZRDP provides access to the services purchased by the Subscriber, including maintenance of the underlying hardware and network infrastructure required to deliver secure and reliable connectivity.

The Subscriber does not acquire ownership of any hardware or software used to provide the Service. Subject to full payment, ATOZRDP grants a non-exclusive, non-transferable license to use the Service in accordance with this Agreement and the Acceptable Use Policy.

Billing and Payments

ATOZRDP issues invoices electronically for all applicable fees, including setup, administration, upgrades, and recurring service charges.

  • Setup and upgrade fees are due immediately upon assessment
  • Recurring service fees are billed in advance
  • Additional usage or overage charges are billed at the end of the billing cycle

Payment Methods

The Subscriber agrees to pay all invoices using payment methods made available on the ATOZRDP website. ATOZRDP reserves the right to accept or decline alternative payment methods at its sole discretion.

Payments and Refund Policy

Electronic invoices serve as proof of payment. If automatic payment fails, the Subscriber must ensure payment is completed before the due date.

  • Refunds are considered only if the service is cancelled within 24 hours
  • Total data usage must not exceed 25 GB
  • No refunds are provided after 24 hours under any circumstances
  • ATOZRDP reserves the right to deny refund requests
  • A processing fee may be deducted from approved refunds

Term and Termination

This Agreement remains in effect until terminated by either the Subscriber or ATOZRDP.

  • Subscribers may terminate services at the end of the billing cycle
  • ATOZRDP may terminate services with 30 days’ prior notice
  • ATOZRDP may terminate with 15 days’ notice if a breach is not corrected
  • Immediate termination may occur for Acceptable Use Policy violations

Public torrent usage and spamming are strictly prohibited on all ATOZRDP servers.

Force Majeure

Neither party shall be liable for delays or failures caused by events beyond reasonable control, including natural disasters, war, labor disputes, or government actions. Obligations will be suspended for the duration of such events.

Indemnification and Disclaimer

The Subscriber agrees to indemnify and hold ATOZRDP harmless from claims, damages, losses, and expenses arising from misuse of services, breach of this Agreement, or actions of the Subscriber.

Services are provided “as is” without warranties of any kind. ATOZRDP is not responsible for data loss, service interruptions, or usage inaccuracies.

Miscellaneous

  • Rights not expressly granted are reserved by ATOZRDP
  • Failure to enforce any provision does not constitute a waiver
  • Invalid provisions do not affect remaining terms
  • ATOZRDP may subcontract services without notice
  • This Agreement does not create a partnership or joint venture
  • ATOZRDP reserves the right to update these Terms with electronic notice
